1. Terms and conditions of use of the site

1.1. Welcome to this website owned and operated by Hong Kong Airsoft Shooting Association (HKASA), (hereinafter referred to as "we", "us", "our"). These terms and conditions of use (“Terms”) solely apply to the access and use of our products, services, content, materials, and information, including content and services provided by any third-party vendors, subject to third-party terms (collectively, “Content”) freely available to you on our webpages, apps, social media accounts, and third-party services (collectively, “Platforms”). These Terms do not govern any offline or in-person services, such as classes or activities conducted at our premises or at your physical facilities. BY USING THIS SITE, YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE LEGALLY BOUND BY THESE TERMS. WE RESERVE THE RIGHT TO TERMINATE YOUR USE OF OUR PLATFORMS IMMEDIATELY AT ANY TIME, ESPECIALLY IF YOU VIOLATE THESE TERMS.

1.2. We may update or otherwise modify these Terms at any time without notice to you, and it is your obligation to check for updates; these changes do not affect rights and obligations that arose prior to such changes. Your continued use of our Platforms following the posting of modified Terms will be subject to the Terms in effect at the time of your use. IF YOU DO NOT AGREE TO THESE TERMS, YOU WILL TERMINATE USE OF OUR PLATFORMS IMMEDIATELY.

2. Intellectual Property Rights

2.1. All Content on our Platforms, in particular, all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, and logos, is protected by copyright, personal rights, database rights, trade secrets, right of confidence, and other similar rights (collectively, “Intellectual property rights (IPR)”). All content is either owned or controlled by us or licensed to us. All rights are reserved by us or, if provided by third-party services, they are reserved by the third-party vendors. You are not permitted to reproduce, copy, post, republish, transmit, record, transfer or process any content, materials or portions thereof without our express written permission in advance, nor are you permitted to do or attempt anything that violates our intellectual property rights or any intellectual property rights licensed to us or owned by third-parties.

2.2. Our Platforms may utilize or incorporate content and services from third-party vendors. You acknowledge and agree that your right to use such content or services of third- parties may be subject to additional terms and conditions of the third-party vendors providing these services. IF YOU DO NOT AGREE TO THESE ADDITIONAL CONDITIONS, YOU WILL TERMINATE USE OF THE RESPECTIVE THIRD-PARTY CONTENT OR SERVICES.

3. User Etiquette

3.1. We are thrilled to have you learn and enjoy our Content on our Platforms, hence for your best browsing experience, you are granted a limited license to use our Content for your personal, non-commercial use only, i.e., you will not use our Content provided as part of your commercial business ideas or any other commercial activities, nor to reproduce or modify our Content. All IPR notices presented on Our Website must appear on all copies you print. Your continued enjoyment of our Content is based on the condition that you comply with applicable laws, not violate our rights or the rights of third-parties, use that Content solely in a manner consistent with these Rules and do not destroy, damage or otherwise exploit it.

All photographs, images, videos, and likenesses of members, participants, instructors, guests, or any individuals displayed on our Platforms (“Media Content”) are protected by copyright and personal rights. You are strictly prohibited from downloading, copying, reproducing, screenshotting, modifying, distributing, publishing, transmitting, storing, scraping, data‑mining, or otherwise using any Media Content without our prior written consent. Any unauthorized use of Media Content, including but not limited to use for defamatory, misleading, political, commercial, artificial intelligence training, facial recognition, harassment, or other malicious purposes, is strictly prohibited and may result in legal action.

4. Third-Party Platforms and Content

4.1. Links on our Platforms are for your reference and convenience, may take you to third- party websites and you acknowledge and agree that we have no responsibility, nor guarantee the accuracy or availability of any content, products, or services provided by third-parties. Links to third-party websites do not constitute an endorsement or recommendation by us of such websites or the content, products, services, advertising or other materials available unless expressly specified by us. You agree to indemnify and hold us harmless, in particular, for legal fees and costs, from any claims, damages, or losses arising from your use of third-party services accessed through our Platforms.

5. Limited Liability and Warranty

5.1. We and our representatives, distributors, and licensors, to the maximum extent permitted by applicable law, shall not be made liable, to the maximum extent permitted by law for our free Content, whether by contract, tort (including and without limitation negligence) or other act or omission, regardless of whether such act or omission is direct, indirect, consequential or specific. The exclusions set forth in this
section apply even if the loss or harm suffered by you was or should have been foreseen by us and/or you informed us of the risk that you suffered the loss or harm. Nothing in these Terms shall limit or exclude your statutory rights as a consumer.

5.2. Our Content is provided on an “AS IS” and “AS AVAILABLE” basis for your personal use only. We make no representation or warranty of any kind, express or implied.

6. Safety and Informational Disclaimer

6.1. Content provided on our Platforms is for general informational purposes only and does not constitute professional training, safety instruction, legal advice, or certification. Participation in airsoft shooting, practical shooting, or related activities involves inherent risks. Users are solely responsible for ensuring that they comply with all applicable laws, regulations, safety requirements, and range rules. We assume no responsibility or liability for any injury, damage, loss, or legal consequences arising from reliance on any information presented on our Platforms.

7. Indemnity

7.1. You agree to defend, indemnify and hold us, our representatives, distributors, and licensors, harmless from and against all liabilities, damages, claims, actions, costs and expenses (including legal fees), in connection with or arising from your breach of these Terms. We may, if necessary, participate in the defence of any claim or action and any negotiations for settlement. You will not make any settlement that may adversely affect our rights or obligations without our prior written approval. We reserve the right, at our own expense and on notice to you, to assume exclusive defence and control of any claim or action.

8. Platform(s) Management

8.1. We reserve the right, but not the obligation, to:
8.1.1. monitor our Platforms for violations of these Terms;
8.1.2. take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms, including without limitation, reporting such user to law enforcement authorities;
8.1.3. otherwise manage our Platforms in a manner designed to protect our rights and property and to facilitate the proper functioning of our Platforms.

10. Dispute resolution and governing law

10.1. These Terms shall be governed by and construed in accordance with the Laws of the Hong Kong Special Administrative Region (HKSAR).

10.2. The parties shall first attempt in good faith to resolve any dispute, controversy or claim arising out of or in connection with these Terms through mediation in Hong Kong. If the dispute is not resolved through mediation within a reasonable period, either party may refer the matter to the courts of Hong Kong, which shall have exclusive jurisdiction.


10.3. The original version of the Rules is in English. Any translated version is for your convenience and information only. In case of disputes the English text shall prevail.
